Terms & Conditions – OFHEALTHS

Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
Ancillary Contract:
An additional agreement under which the Consumer purchases products, digital content, or services related to a Distance Contract, supplied by OFHEALTHS or a third party under an arrangement with OFHEALTHS.
Grace Period:
The period during which the Consumer may exercise their Right of Withdrawal.
Consumer:
A natural person acting outside of a trade, business, or profession who enters into a contract with OFHEALTHS.
Day:
A calendar day.
Digital Content:
Data or materials produced and supplied in digital form.
Ongoing Contract:
An agreement involving repeated or continuous delivery of products or services.
Durable Medium:
Any medium that allows the Consumer or OFHEALTHS to store information for future reference and reproduce it unchanged, including email.
Right of Withdrawal:
The Consumer’s right to cancel a Distance Contract within the Grace Period.
Model Form:
The standard withdrawal form provided by OFHEALTHS.
Entrepreneur / OFHEALTHS:
The legal entity offering products, digital content, and/or services remotely to Consumers.
Distance Contract:
An agreement formed through OFHEALTHS’s online or digital platform without face-to-face interaction.
Means of Distance Communication:
Any method used to conclude a Distance Contract without both parties being physically present.
General Terms and Conditions:
These Terms and Conditions as set forth by OFHEALTHS.

Article 3 – Applicability
These Terms and Conditions apply to every offer made by OFHEALTHS and to all Distance Contracts and transactions between OFHEALTHS and Consumers.
Before a Distance Contract is concluded, the text of these Terms and Conditions will be provided to the Consumer. If not feasible, OFHEALTHS will state where they can be accessed electronically and will provide a copy free of charge upon request.
For electronically concluded contracts, these Terms will be provided in a format that allows the Consumer to store and reproduce them.
If additional terms apply to specific health products or services, both these and the present Terms apply. In case of conflict, the Consumer may rely on the more favorable clause.
If any clause is deemed invalid, the remaining provisions remain fully effective. The invalid clause will be replaced with one closest in meaning to the original.
Ambiguities will be interpreted consistent with the intent of these Terms and Conditions.
Article 4 – The Offer
If an offer has limited validity or specific conditions, this will be stated clearly.
All offers by OFHEALTHS are non-binding and may be adjusted or withdrawn at any time.
OFHEALTHS strives to provide accurate descriptions and images of all health products and supplements offered. Minor variations, ingredient updates, or typographical errors do not constitute grounds for claims.
Product images are for reference only and may vary slightly from actual items.
Each offer includes sufficient details for the Consumer to understand their rights and obligations, including:

Total price including applicable taxes

Shipping costs (if any)

Steps required to form the contract

Whether the Right of Withdrawal applies

Payment, delivery, and performance terms

Duration or renewal conditions (if applicable)
Article 5 – The Contract
The contract is formed once the Consumer accepts the offer and fulfills the stated conditions.
For electronic contracts, OFHEALTHS will acknowledge receipt promptly. Until this confirmation is received, the Consumer may withdraw their acceptance.
OFHEALTHS maintains secure technical and organizational systems to protect data and payment details.
OFHEALTHS reserves the right to verify payment capability. Orders may be refused or conditionally approved if justified.
Upon conclusion of the contract, OFHEALTHS will provide:

Article 6 – Right of Withdrawal
Products (Health & Supplement Items)
Consumers may cancel purchases within 30 days of receiving the product.
For multi-item orders, the period begins once all products have been received.
Consumers must handle the product carefully and only inspect it as necessary without breaking safety or hygiene seals, which voids eligibility for withdrawal.
To exercise the Right of Withdrawal, the Consumer must notify OFHEALTHS via email within 30 days of delivery and must return the item(s) within an additional 30 days.
Services and Digital Content
For digital content not supplied on a physical medium or for services, Consumers may withdraw within 14 days of contract conclusion.
Extended Withdrawal
If OFHEALTHS fails to provide required withdrawal instructions, the period extends up to 12 months after the initial deadline.
Article 7 – Costs of Withdrawal
Consumers bear the return shipping costs unless the product is defective or incorrectly delivered.
OFHEALTHS will refund the purchase amount within 10 business days after receiving the returned goods or proof of shipment.
Depreciation caused by improper handling may be deducted.
Article 8 – Exclusion of the Right of Withdrawal
Withdrawal does not apply to:

Health products or supplements with broken seals

Personalized or custom-assembled items
-
Perishable or expiring goods
-
Digital products once accessed or downloaded

Services fully performed before the withdrawal deadline with Consumer consent

Safety-sealed items opened after delivery
Article 9 – Prices
Prices will not change during the validity of an offer unless required by law.
Some products may have variable pricing based on market or ingredient fluctuations.
All prices are listed in U.S. dollars and exclude customs duties or import VAT.
OFHEALTHS is not liable for typographical or pricing errors.
Article 10 – Warranty and Conformity
OFHEALTHS guarantees that all products conform to the contract and meet quality, purity, and safety standards relevant to health supplements.
Defects must be reported within 4 weeks of delivery.
Warranty does not apply if the Consumer misuses, tampers with, improperly stores, or alters the product.
Article 11 – Delivery and Fulfillment
OFHEALTHS processes and ships orders to the address provided by the Consumer.
Processing time: 1–3 business days
Delivery time: 5–7 business days
In case of significant delay, the Consumer will be informed and may cancel if the delay exceeds 30 days.
Risk transfers upon delivery.
Article 12 – Duration, Termination, and Renewal
Consumers may terminate ongoing service contracts with one month's notice.
Fixed-term contracts cannot renew automatically without explicit Consumer consent.
Contracts exceeding one year may be terminated after the first year with one month’s notice.
Article 13 – Payment
Payment must be made within 7 business days unless stated otherwise.
Consumers must provide accurate and complete payment details.
In cases of non-payment, OFHEALTHS may recover reasonable collection costs.
Article 14 – Complaints Procedure
Complaints should be sent to:
OFHEALTHS will respond within 3 days.
If more time is required, the Consumer will be informed of the expected timeline.
Unresolved disputes will be handled under the appropriate legal jurisdiction.
Article 15 – Governing Law
These Terms and all agreements between OFHEALTHS and the Consumer are governed by the laws of the United States.
Article 16 – Additional Provisions
Additional or alternative clauses must not disadvantage the Consumer and must be provided in writing or on a durable medium.
Article 17 – Acceptance of Replacement Items
If the Consumer accepts a free replacement (e.g., corrected or substitute item), they forfeit the right to return the replacement, as the cost is already absorbed by OFHEALTHS.
Article 18 – Payment Obligation
By placing an order, the Consumer agrees to these Terms and confirms their obligation to pay.
Refunds or chargebacks do not nullify this obligation.
OFHEALTHS reserves the right to recover payments reversed without valid reason.
Article 19 – Reshipment Rights
OFHEALTHS reserves the right to resend products when:

A shipment error occurred

A product arrived defective

A return was incorrectly processed
Article 20 – Promotional Offers
All promotional offers are non-binding and may be altered or withdrawn at any time.
Each offer will specify its price, duration, payment terms, and applicable conditions.
Article 21 – CESOP Compliance
Under CESOP regulations implemented in 2024, payment service providers may record and report relevant transaction data to European authorities for compliance purposes.
